MINIMUM SALARY WAS 300 MANATS

The minimum salary of employees cannot be less than AZN 300 from January 1, 2022

According to the Decree of the President of the Republic of Azerbaijan Ilham Aliyev dated December 17, 2021, the State Labor Inspection Service under the Ministry of Labor and Social Protection of the Population appeals to employers regarding the increase of the minimum salary to 300 manats from January 1, 2022.

The service brings to the attention of employers that until January 1, 2022, the employment contracts stipulatingsalaries lower than the minimum salary must be amended in accordance with the requirements of the legislation and the relevant employment contract notification must be included in the “EmploymentContract Notification” subsystem. The minimum salary in workplaces cannot be less than 300 manats from January 1.

The situation in this field is constantly monitored through the Ministry’s “Employment Contract Notification” subsystem. All information about concluded employment contracts, as well as changes or termination of contracts, is covered in that subsystem. This subsystem allows real-time monitoring of data on all salaries determined under employment contracts concluded at workplaces.

In connection with the increase of the minimum salary, employers must make appropriate increases in the salaries of employees who are paid according to the Unified Tariff Schedule consisting of 19 levels, and appropriate measures must be taken in this regard.

Article 192.3 of the Code of Administrative Offenses stipulates that officials shall be fined from one thousand manats to and one thousand and five hundred manats for paying an employee a salary less than the minimum salary.

If it is found that the salary is lower than the minimum salary, in accordance with Article 127-4.1 of that Code, proceedings on the administrative offense case will be started in real time without the presence of the person who committed the administrative offense.
